Mid Cap Watch List Changes

With the end of the first quarter approaching, it is time to adjust the names in our Watch Lists. We will price all the new lists as of the close on Friday, March 30. Today we present our planned updates to the Mid Cap Watch List (Track at Marketocracy).

As with the Small Cap Watch List (Track at Marketocracy), we were surprised at the amount of turnover in our screens. Only 7 of the original 29 names made the cut for the new list (which comes in at only 24 names.) Part of the reason for the turnover was to reduce the overlap between the Small Cap and Mid Cap Watch List (Track at Marketocracy)s. Now there is only one-third overlapping names rather than two thirds. Furthermore, given the level of outperformance we saw in the first quarter (actually just two months) and the fact that much of those gains were achieved early, perhaps the turnover is warranted.

So without further ado, the names on the chopping block from the previous list are:

Small Cap Watch List Changes

Frankly, we were surprised at the amount of turnover in our screens. Only 9 of the original 29 names made the cut for the new list (which comes in at only 24 names.) Still, given the level of outperformance we saw in the first quarter (actually just two months) and the fact that much of those gains were achieved early, perhaps the turnover is warranted.

So without further ado, the names on the chopping block from the previous list are:

MIDD: Middleby Makes Mistake - Doesn’t Everyone?

Small Cap Watch List (Track at Marketocracy) and Mid Cap Watch List (Track at Marketocracy) member The Middleby Corporation (MIDD) Notifies NASDAQ of Non-Compliances with NASDAQ Marketplace Rule:

The Middleby Corporation (MIDD) today announced that it received a letter from the Nasdaq Staff dated March 12, 2007, indicating that the Company failed to comply with the shareholder approval requirements for continued listing set forth in Nasdaq Marketplace Rule 4350(i)(1)(A) as a result of the Company’s inadvertent issuance in May 2006 of options to purchase 3,500 shares of the Company’s common stock to its outside directors without shareholder approval.The Company self-reported its non-compliance to the Nasdaq Staff on March 8, 2007 and, on its own initiative, immediately rescinded the option grants. Accordingly, the Nasdaq Staff has determined that the Company has regained compliance with Nasdaq Marketplace Rule 4350(i)(1)(A) and the matter is now closed.

Obviously it can be a bad thing when a company violates a rule that could cost it its market listing. On the positive side, the company self-reported and fixed the issue, so all now appears well. Given how busy the company has been with growing and making shareholders wealthier, we are inclined to cut them some slack.

MIDD: Middleby Earnings Not Middling

Small Cap Watch List (Track at Marketocracy) and Mid Cap Watch List (Track at Marketocracy) member Middleby Corporation (MIDD) Reports Record Fourth Quarter Results: Financial News - Yahoo! Finance:

Middleby Corporation (NASDAQ:MIDD - News), a leading worldwide manufacturer of restaurant and foodservice cooking equipment, today reported record net sales and earnings for the fourth quarter ended December 30, 2006. Net earnings for the fourth quarter were $11,059,000 or $1.34 per share on net sales of $98,294,000 as compared to the prior year fourth quarter net earnings of $7,233,000 or $0.88 per share on net sales of $76,930,000. Net earnings for the fiscal year ended December 30, 2006 were $42,377,000 or $5.13 per share on net sales of $403,131,000 as compared to net earnings of $32,178,000 or $3.98 per share on net sales of $316,668,000 in the prior year.

We didn’t notice anything too concerning in the financial statements, and the stock is up sharply on the news. The company, which makes commercial cooking equipment used in restaurants, has made several acquisitions over the last couple of years, and these are helping to drive solid growth, and while the multiple is high it does not appear excessive given this growth.

We asked, but no one answered. So we are taking our own counsel and breaking our Watch List into three portfolios: Small Cap, Mid Cap and Large Cap. Each will be tracked against the relevant S&P index going forward from their collective inception date of January 31 (priced at the close of market trading that day.)

For your viewing pleasure, the Mid Cap Watch List (Track at Marketocracy) (to be measured against the S&P 400) follows.

Astute observers will notice a significant overlap between the names in the Small Cap Watch List and this one. In fact, of the 29 names on the Small Cap Watch List (Track at Marketocracy), 19 are included among the 29 names in the Mid Cap Watch List (Track at Marketocracy). The main reason is that we ran our screens against the criteria in the relevant indices rather than the names in the indices. Since the largest market cap in the S&P Small Cap is $3.5 billion and the smallest market cap in the S&P Mid Cap is $600 million, there is room for a good deal of overlap if one is willing to accept it.

In addition, we will provide a “quick and dirty” analysis of each name, with a goal of one such analysis per day. As the name implies, the quick and dirty analysis will be incomplete. We are hoping you will join in the debate and fill the gaps in our analysis.
